REP ANTHONY SABATINI URGES REPEAL OF LEAHY-SMITH AMERICA INVENTS ACT

US Inventor, representing inventors and innovative small businesses and startups across America, applauds Florida State Representative Anthony Sabatini for standing firmly behind more than 12,000 Florida small business inventors and calling for the repeal of the bill that has done more harm to inventors and innovative small businesses than any bill in history – The Leahy-Smith America Invents Act of 2011.

Rep. Sabatini introduced to the Florida House of Representatives House Memorial 581 on Friday, November 12, 2021, urging the United States Congress to repeal the Leahy-Smith America Invents Act of 2011 (AIA).

In the Memorial Rep. Sabatini points our several specifics concerning the AIA including, quite notably, that the AIA “represents a negative legislative change to the United States patent system,” and that Act “is not about strengthening the patent granting system but about making it harder for patent owners to assert patents to protect their rights.”

The above has been proven by the Act’s creation and results of the Patent Trial and Appeal Board (PTAB), an administrative tribunal that has become known as “the patent death squad.”

Since inception, the PTAB is responsible for destroying the lives and livelihoods of thousands of independent inventors and innovative small businesses and startups through their decisions to invalidate 84% of the 3,000+ patents they have reviewed, primarily in favor of Big Tech and multi-national corporations, including those controlled by the Chinese Communist Party (CCP). Facts, as they say, speak for themselves.

Near the end of the Memorial, Rep Sabatini drops the bombshell, stating “the Leahy-Smith America Invents Act is of dubious constitutionality and only helps big corporations, destroying the power of the small inventor.”

Doing away with the AIA and the PTAB and, as Rep. Sabatini notes, reverting to “the fair system that was in place before the passage of the Leahy-Smith America Invents Act” would most certainly unleash the power of American ingenuity once again.
