U.S. Inventor’s Statement on Vishal Amin’s Potential Appointment to USPTO: A Threat to U.S. Innovation, National Security, Economic Growth, and Trump’s MAGA Agenda
(WASHINGTON, DC) – The proposed appointment of Vishal Amin to head the U.S. Patent and Trademark Office (USPTO) would be detrimental to American innovation, economic growth, and national security. As a central architect of the America Invents Act (AIA) of 2011, Amin has consistently prioritized the interests of big tech corporations over individual inventors and small businesses. Amin’s policies have allowed foreign powers-particularly China- to gain a technological edge, undermining U.S. leadership in critical industries. Amin’s background as Intel’s lobbyist-in-chief makes him unsuitable to lead the USPTO, an agency tasked with protecting American intellectual property.
“President Trump can cause a renaissance in American innovation by ending the strangle-hold of Big Tech on the US Patent Office and unleashing American inventors and startups, much like George Washington did with the Patent Act of 1790.”, urged US Inventor President Randy Landreneau. “The opposite will happen if he appoints Big Tech ally Vishal Amin as USPTO Director.”
Key Concerns of Amin’s record and impact of potential appointment:
- Weakened U.S. Innovation: Amin’s AIA facilitated China’s rise in 37 of 44 critical technologies and allowed Intel and other tech giants to game the patent system, invalidating patents held by smaller U.S. competitors.
- Patent Trial and Appeal Board (PTAB): Created by Amin, the PTAB invalidates 84% of patents it reviews, benefiting corporations like Google, Huawei, and DJI- the Chinese drone company banned for national security concerns. The PTAB is a creation of Obama-era policymakers and gives advantages to Big Tech over citizen inventors.
- Conflict of Interest: Amin’s ties to Intel, which continues to expand in China while benefiting from U.S. taxpayer-funded initiatives, create national security concerns.
- Undermining U.S. Efforts: While the U.S. government appropriated billions for semiconductor manufacturing through the CHIPS Act, Intel is instead using these funds to build a new factory in China.
- Undermines America First Agenda: Amin’s policies contradict President Trump’s goal of protecting American workers and intellectual property, as Amin has consistently favored big tech over U.S. inventors and national security.
- Harming U.S. intellectual property: While in the White House, Amin championed policies that benefited Intel, where he later worked. Under his influence, Intel filed hundreds of patent challenges at the USPTO, many involving technologies they were found to have infringed in court, further harming U.S. intellectual property protections.
Call for Leadership Change:
Due to his loyalty to big tech and track record of weakening patent rights for inventors, Vishal Amin must be denied the USPTO leadership position. This next administration must choose a leader who will prioritize U.S. innovation and national security and who will protect the great American system of invention and creation.
